Legal responsibilities and guarantees
In accordance with the provisions of the Civil Code , any builder (contractor, craftsman or project manager) is required to guarantee the proper execution of the work , whether carried out directly or by subcontracting.
Depending on the nature of the disorder, different legal guarantees apply:
- Perfect completion guarantee : 1 year from receipt of work;
- Two-year warranty (or proper functioning) : 2 years for detachable elements of the frame;
- Ten-year guarantee : 10 years for damage compromising the solidity of the structure or making it unfit for its intended purpose.
The project owner (i.e. the owner who ordered and financed the work) may hold the builder liable within these time limits, unless the latter demonstrates that the cause of the problem is beyond his control.
